Trademarks
Trademark Clearance Search
We'll perform a thorough search of existing trademarks to see if your desired mark is available and likely to be approved for registration. Our goal is to give you a clear understanding of any risks or challenges and to determine the legal viability of your trademark before you invest further in the application process.

Response to Office Action
If your application receives an Office Action (an official refusal, often due to concerns about confusingly similar pre-existing marks), we can help. We will analyze the reasons for refusal, gather necessary information or evidence, and craft a clear and persuasive argument to address the USPTO’s concerns. Our goal is to overcome the refusal and ensure that your trademark proceeds to registration.
Flat Fee - Dependent on details.
Can range from $250 to $2,500.
(There is no fee for simple Office Action responses if we filed your application.)
Other Services
Cease and Desist Letter $500
Do you have a trademark infringement issue? We can send a cease and desist letter to help enforce your rights. Litigation services are not included.
Co-Existence Agreement $1,000
A co-existence agreement might be a good solution to a trademark conflict. We can negotiate and draft an agreement allowing both parties to use their trademarks without conflict.
Renewal $150 plus USPTO fees
Once you own a trademark registration, you must occasionally do things to keep it alive.
Allegation of Use $150 plus USPTO fees
If you filed your application on the "intent-to-use" basis, you will eventually need to submit proof of actual use.
Trademark Registration Lawyer
About Long Run Legal LLC
I'm David O'Brien, a trademark lawyer with a love for family and fun. I bring close attention and a unique perspective to my work, combining years of teaching law and philosophy (to high schoolers) with hands-on experience in my wife's online business. I enjoy helping clients protect their brand identity because every trademark represents an admirable and inspiring quest to turn a dream into a reality. To me, a trademark is symbol of optimism, determination, and achievement.
When I'm not working, you'll find me spending time with my wife, Elizabeth, and our two kids, or exploring the outdoors through long-distance trail runs fueled by hours of audiobooks (and the occasional trademark podcast). We absolutely love our historic river town, kayaking, picnics with friends, CrossFit, the library, biking everywhere, and all the other beautiful, simple riches of life.
I feel very lucky. I find trademark law to be genuinely interesting, and it’s always a pleasure to learn about a business and its brand and to work together with driven, creative individuals.
I strive to make trademark issues and the trademark process smooth and stress-free for you. Let's work together to protect your brand for the long run!
